Maribel Quilez-Bonelli died from injuries she received in an automobile accident with a truck used by employees of the Municipality of San Juan. The truck had fitted onto its trash body an underride guard designed by Ox Bodies, Inc. Maribel’s family members (collectively, Quilez) brought suit in federal district court against Ox Bodies, seeking damages for negligence and defective design of the under ride guard. A jury found Ox Bodies strictly liable for defective design and awarded Plaintiffs $6 million in damages. The jury assigned twenty percent of responsibility for the damages to Ox Bodies and eighty percent to the Municipality of San Juan, which was not a party in the suit. The magistrate judge ruled that Ox Bodies should be held responsible for only twenty percent of the damages award. Both parties appealed. The First Circuit (1) affirmed the magistrate judge’s decision to admit the testimony of Quilez’s expert regarding an alternative underride guard design; and (2) as to Quilez’s appeal, certified to the Supreme Court of Puerto Rico the question of the extent of Ox Bodies’ liability for the damages award. Jim Bishop Chevrolet-Buick-Pontiac-GMC, Inc. ("Jim Bishop"), appealed judgment entered on jury verdicts in favor of Michael and Tina Burden ("Burden"). In 2012, the Burdens sued General Motors, LLC, Jim Bishop, and Lynn Layton Chevrolet, Inc. ("Lynn Layton"), to recover damages for injuries they allegedly sustained as the result of a fire that occurred in a truck they had purchased from an automobile dealership owned and operated by Jim Bishop. When Jim Bishop filed its answer, also generally denying the allegations contained in the complaint and asserting certain affirmative defenses, Jim Bishop further asserted a cross-claim against General Motors alleging it had refused to indemnify Jim Bishop. The Burdens eventually entered into pro tanto settlements with General Motors, which agreed to pay them $20,000, and Lynn Layton, which agreed to pay them $32,000, as to the respective claims asserted by the Burdens against those defendants. The settlement with General Motors resolved the breach-of-warranty claims and the "Magnuson-Moss" claim. The trial court dismissed the Burdens' claims against both General Motors and Lynn Layton pursuant to joint stipulations of dismissal filed by those parties. Jim Bishop moved the trial court for a summary judgment on the Burdens' remaining claims against it, moved at the close of evidence for a judgment as a matter of law, and renewed its JML motion post-verdict. All three were denied, and the jury returned its verdict against Jim Bishop. Based on its review of the facts entered into the trial court record, the Supreme Court concluded that the trial court erred in failing to grant Jim Bishop's motion for a JML and in submitting the case to the jury. The Textron Lycoming engine, manufactured in 1969, was installed on a Cessna aircraft in 1998. It was overhauled in 2004, with a carburetor in accordance with Lycoming’s type-certificated design. Sikkelee was piloting the aircraft when it crashed shortly after taking off. Sikkelee died. His estate sued, claiming that the aircraft lost power as a result of a malfunction or defect in the carburetor. The court held that Sikkelee’s claims, which were premised on state law standards of care, fell within the preempted “field of air safety.” An amended complaint incorporated federal standards of care by alleging violations of FAA regulations. Before trial, the court concluded that the federal standard of care was established in the type certificate. Reasoning that the FAA issues a type certificate based on its determination of compliance with pertinent regulations, it held that the FAA’s issuance of a type certificate for the engine meant that the federal standard of care had been satisfied as a matter of law. The court granted Lycoming partial summary judgment and certified an immediate appeal. The Third Circuit reversed, concluding that federal statutes and FAA regulations reflect that Congress did not intend to categorically preempt aircraft products liability claims. Subject to traditional principles of conflict preemption, including concerning specifications included in a type certificate, aircraft products liability cases may proceed using a state standard of care. Plaintiff, a salesman for Kaiser Refractories, filed suit against manufacturers and suppliers of asbestos-containing products, including Foster Wheeler, a manufacturer of industrial boilers insulated with refractory, alleging causes of action for, among other things, strict liability and negligence/failure to warn. The jury returned a verdict for Foster Wheeler and plaintiff appealed. The court agreed with plaintiff that the evidence is insufficient to support the verdict, because substantial evidence fails to prove, as required for the sophisticated user defense, that by virtue of his position, training, experience, knowledge, or skill, he knew or should have known of the health risks posed by working with or near the asbestos-containing products he sold and which were used in Foster Wheeler boilers. The class representatives in three suits had purchased the Smoothing Kit, a hair product that supposedly would smooth hair and coat it with Keratin, a protein found naturally in hair. The Smoothing Kit was a disaster. Its active ingredient is extremely corrosive; if left on long enough, can dissolve the hair and burn the scalp. Asserting claims for breach of warranty, violations of state consumer fraud and deceptive practices laws, and unjust enrichment, plaintiffs in several states filed class action lawsuits. The cases were consolidated in the Northern District of Illinois, resulting in a settlement agreement. Martin objected to its approval which would provide a one‐time payment of $10 per person (the cost of the Smoothing Kit) plus payment to who suffered bodily injury. The Seventh Circuit upheld the approval, rejecting Martin’s argument that the personal injury settlement’s value was too low because it failed to recog‐ nize that there are a number of different applicable laws. The district court reasonably concluded that it had enough data for an informed decision and that the dollar amounts were within a reasonable range and reasonably considered and rejected injunctive relief. Plaintiffs, two separate couples, brought suit seeking damages stemming from asbestos-caused diseases. Several Defendants in each case moved for summary judgment. In the first lawsuit, which led to two interlocutory appeals, the trial court denied Defendants’ motions for summary judgment. In the second lawsuit, the trial court entered summary judgment for Defendants as a final judgment. At issue in each appeal was the trial court’s ruling on a motion for summary judgment asserting the ten-year statute of repose included in Indiana’s Product Liability Act. In all three appeals, which the Supreme Court consolidated, Plaintiffs requested reconsideration of the Court’s prior holding in AlliedSignal v. Ott. The Supreme Court (1) declined to reconsider Ott’s holdings with respect to statutory construction due to the principles of stare decisis and legislative acquiescence; but (2) concluded that the Product Liability Act’s statute of repose did not bar Plaintiffs’ claims, as the Act’s statute of repose does not apply to cases such as these where the plaintiffs have had protracted exposure to inherently dangerous foreign substances. Plaintiff filed a product liability suit against Remington after her husband, Kenneth Seamon, died from a gunshot wound while deer hunting alone. Plaintiff alleged that Mr. Seamon died as a result of a defect in his Remington Model 700 bolt action rifle. On appeal, defendant challenged the district court's exclusion of the causation opinion of plaintiff's liability expert and the district court's grant of defendant's motion for summary judgment. In this case, the expert provided a reasonable explanation for why the defense's proposed alternative cause - trigger pull - was not in fact the cause of Mr. Seamon's death. In holding that the expert's opinion was based on speculation, rather than facts in the record, the court concluded that the district court also mischaracterized the evidentiary support for the expert’s opinion in several ways. Therefore, the court reversed the district court's judgment regarding the motion to exclude, and consequently the motion for summary judgment, remanding for further proceedings. View "Seamon v. ALL leased a crane to White Construction. Carson worked for White, providing general maintenance and serving as the “eyes and ears” of crane operator Dowell. Carson and Dowell were told to move the crane to a wind turbine platform several miles away. As the crane approached a road with overhead power lines. Carson signaled for Dowell to stop at the base of some wood matting placed to help the crane cross the road. Dowell stopped, but the crane began moving again, onto the matting where Carson was standing. As the crane pushed one end down, the other end rose. Carson slid down the slope. The crane’s treads crushed his foot, which had to be amputated. Dowell testified that he took the crane out of its “travel detent,” meaning that the crane should not have moved. The crane was inspected by Scholl, hired by White, and by a crane mechanic employed by ALL. Both concluded that the crane had moved forward because a malfunction in the controls caused the throttles to re‐engage without action by Dowell. The problem was intermittent and difficult to replicate and to detect. In his negligence suit, Carson argued that ALL had a duty to reasonably inspect the crane upon delivering it to White. The Seventh Circuit affirmed summary judgment, finding no evidence that ALL’s alleged breach was the proximate cause of Carson’s injury. View "Carson v. All Erection & Crane Rental Co" on Justia Law

This appeal stems from multi-district litigation involving transvaginal mesh medical devices used to treat pelvic organ prolapse and other pelvic issues. The jury awarded plaintiff $250,000 in compensatory damages, and the punitive damages award was split pursuant to a Georgia statute, with seventy-five percent going to the State of Georgia and twenty-five percent going to plaintiff. Both parties appealed. The court affirmed the district court's exclusion of evidence that Bard had complied with the FDA's 510(k) product safety process under F.R.E. 402 for lack of relevance; affirmed the district court's decision to admit evidence of a material data safety sheet pertaining to polypropylene, a material used in the construction of the Avaulta Plus implanted in plaintiff's body, as non-hearsay, finding that any use of the evidence by plaintiff that went beyond the limited purpose for which it was admitted as non-hearsay resulted in harmless error and was not prejudicial to Bard’s defense; and concluded that the district court did not err in giving the Georgia pattern jury instruction, in denying Bard’s request for a modified instruction, or in upholding the jury’s causation finding. The court also concluded that the punitive award was not constitutionally excessive. In regard to plaintiff's challenges, the court affirmed the district court's conclusion that Georgia's split-recovery statute garnishing seventy-five percent of any punitive damages award arising from a product liability judgment does not violate the Takings Clause of the Fifth Amendment. Virl Birch died when the off-road vehicle in which he was riding flipped over and pinned him to the ground. His surviving family members sued Polaris Industries, the vehicle manufacturer, for strict products liability, negligence, and breach of warranty. Polaris argued there was no evidence Birch’s vehicle was defective at the time of sale, and moved for summary judgment. Well after the deadlines for amending the pleadings and for discovery had passed, Birch’s survivors filed motions: (1) to add new theories to their complaint; and (2) for additional discovery. A magistrate judge denied both motions as untimely, and the district court affirmed the magistrate’s ruling. Based on the allegations in the unamended complaint, the district court then granted summary judgment to Polaris on all claims. The survivors appealed the district court’s denial of their two motions and the grant of summary judgment. But finding no reversible error in the district court's judgment, the Tenth Circuit affirmed. View "Birch v. Polaris Industries" on Justia Law
